On January 13, 2023, the Attorney General signed ATF final rule 2021R-08F, “Factoring Criteria for Firearms with Attached ‘Stabilizing Braces,’” amending ATF’s regulations to clarify when a rifle is designed, made, and intended to be fired from the shoulder.

On January 31, 2023, ATF final rule 2021R-08F, “Factoring Criteria for Firearms with Attached ‘Stabilizing Braces,’” was published in the Federal Register and became active.
This letter is to inform our customers that under the new rule, effective January 31, 2023, any Omni Hybrid, Milsport or Galeo pistols that were sent to you between December of 2018 and January of 2022 that included an attached Trinity Force Breach Brace, are now classified as Short Barreled Rifles.
During the 120 day amnesty period under the rule, American Tactical advises our customers who do not wish to register these firearms with the NFA Branch to simply remove and dispose of the Breach Brace on any Omni Hybrid or Milsport pistols. The amnesty period ends May 31, 2023.
Relating to the Galeo pistols; under the rule, as the pistol buffer tube is merely a cosmetic accessory and is not “necessary for the cycle of operations” of the firearm, it is our understanding that those who do not wish to register Galeo’s with the NFA Branch must also remove and dispose of the pistol buffer tube from the rear of the firearm.
American Tactical will no longer accept unregistered firearms for warranty service if they are sent to us with a “Stabilizing Brace” device attached to them. During the 120 day amnesty period, any firearms we receive that contains any type of device attached to them that may be considered a “Stabilizing Brace,” will be removed and disposed of by American Tactical according to the guidance provided by the BATFE. Following the 120 day amnesty, firearms sent to us that contain a “Stabilizing Brace” will be referred to our local ATF for guidance.
Attached to this letter is a list of all American Tactical part numbers and UPCs that were manufactured and originally disposed lawfully between December 2018 and January 2022 as pistols. American Tactical discontinued selling pistols with attached accessories on 1/31/2022 officially in an attempt to mitigate any future impact of the Rule as proposed at that time.
The Omni Hybrid and Milsport firearms on this list were manufactured in the USA and do not contain more than 10 foreign parts as listed in 18 USC 922r. Galeo Pistols utilizing a US made magazine contain exactly 10 foreign parts from 18 USC 922r.
